Lawyers and others dealing in real estate should have an understanding of the meaning of the words "title" and "marketable" (or "unmarketable") title. Lawyers are frequently called upon to provide opinions as to someone's title to realty. Whether or not one's title to realty is "marketable" (or "unmarketable") will usually determine whether or not an insurer's indemnification obligation under a title insurance policy will be triggered.
